Domestic Violence

Domestic violence is defined as the use of physical, emotional, or sexual abuse or violence, or threat of such violence, against one individual by another in a family or romantic relationship.

Domestic violence includes molesting, attacking, striking, stalking, threatening, sexually assaulting, battering, harassing, telephoning (including annoying calls), destroying personal property, and other unlawful behaviors.  At times, even without any physical contact, domestic violence may exist as it placed the person in reasonable fear of imminent serious bodily injury to that person.

If you are the victim of domestic violence, the first step is to call the police.  The police can provide you with an emergency protective order. Once you are safe, you should seek the advice of a domestic abuse attorney as the next step will require seeking a restraining order to protect you and your family from further instances of violence.

The Law Offices of Anat Resnik also provide assistance to individuals who have been accused or charged with domestic violence and are interested in fighting a restraining order that has been placed against them.

Custody Disputes amid Domestic Violence

Restraining orders often impact child custody disputes.  California laws protect children from environments of domestic violence and abuse. When a child is thought to be in such an environment, the Court may make custody and visitation orders for the protection of the child, and, in some cases, the child may be completely removed by child protective services. Therefore, if you were served with a restraining order against you, and you are involved in a child custody dispute, you will need to speak with a domestic violence attorney immediately to protect your rights.

Likewise, if you are the victim of violence and have been issued restraining orders against someone with whom you are involved in a custody dispute, it is equally important to seek legal counsel immediately to ensure that the court hears all necessary and relevant evidence that your legal counsel can gather.
